Did AG Exceed Power In Appointing Gopal Sri Ram?

Rosmah Mansor, wife of former Prime Minister Najib Razak claims Attorney-General (AG) Idrus Harun had exceeded his jurisdiction by appointing Gopal Sri Ram as the senior deputy public prosecutor to lead the 1Malaysia Development Berhad (1MDB) scandal investigations and to prosecute those involved.

Rosmah claimed in her supporting affidavit which was filed with a notice of motion to disqualify Gopal to lead the prosecution team in her money laundering and tax evasion trial, Malaysian National News Agency (Bernama) reported.

The notice was filed Thursday (27 Jan) and the copies were distributed to the press by her counsel Geethan Ram Vincent.
In the supporting affidavit, Rosmah said after examining the former Federal Court judge’s letter of appointment dated 21 May 2021, under Section 376 (3) of the Criminal Procedure Code, she found that the appointment did not refer to her case.

She said if the court was of the view that Idrus had acted in an orderly manner in line with his statutory powers, then Gopal was still not a “fit and proper” individual to prosecute the case.

Rosmah is accused of soliciting RM187.5 million and two counts of receiving bribes of RM6.5 million from Jepak Holdings Sdn Bhd’s former managing director Saidi Abang Samsuddin, through her former special officer Rizal Mansor.

She was accused of committing the offences between Jan 2016 and Sept 2017.

She purportedly received the money in exchange for helping the company obtain an RM1.25 billion project to provide solar energy to 369 rural schools in Sarawak. – New Malaysia Herald
